Smoke Free/Tobacco Free Policy & Procedure

I. Purpose & Scope:

Oakland Community College (OCC) is committed to the health and wellness of its students, faculty, staff and visitors. This smoke-free and tobacco-free policy helps students, employees and visitors to learn and work in a healthy environment.

II. Policy Statement:

In accordance with Michigan’s Smoke-Free Indoor Air Law, MCL 333.12601 et. seq.; and the Youth Tobacco Act, MCL 722.641- 645, and including any amendments to each law, OCC prohibits all forms of smoking and/or the use of tobacco, vapor and/or nicotine products within thirty (30) feet of any College owned, operated, and/or leased buildings, facilities, and inside vehicles.

This prohibition applies to all employees, vendors, contractors, students, and the public.
Notwithstanding the foregoing, FDA-approved nicotine replacement therapy products are permitted when used for cessation purposes.

III. Definitions:

Smoking: the burning and inhaling of any of the following: lighted cigar, cigarette, e-cigarette, pipe, vaping device, or any other matter or substance that contains a tobacco or nicotine alternative product.

Tobacco products: include, without being limited to, cigarettes/including clove, bidis, kreteks electronic cigarettes, aerosol or vapor nicotine delivery devices, cigars and cigarillos pipe tobacco, hookah-smoked products, oral tobacco (spit or spitless, smokeless, chew, snuff), synthetic and alternative nicotine products and oral nicotine patches.

IV. Smoke-Free and Tobacco-Free Enforcement Procedures:

All staff, faculty and students share in the responsibility of enforcing this policy. If an individual is observed to be in violation of this policy, the following steps are recommended:

1. Politely remind the person of the smoke and tobacco free policy. A reminder or pointing to smoke-free and tobacco-free signage may be all that is needed.
2. If the matter concerns an employee, the employee’s supervisor may be advised.
3. Should the matter persist, a complaint may be filed (Complaint) and an appropriate investigation shall take place.

V. Cannabis:

All Cannabis is illegal on campus due to federal regulations, specifically the Drug-Free Schools and Communities Act.
